Please read this agreement carefully before registering for or participating in Pathway Baseball Group services. This agreement combines the participant liability waiver, assumption of risk, and service disclaimer used for Pathway programs, evaluations, training, and advisory services.
PART I - PARTICIPANT LIABILITY WAIVER & ASSUMPTION OF RISK
1. Voluntary Participation
Participation in Pathway Baseball Group activities is voluntary. Activities may include baseball instruction, hitting, throwing, pitching, fielding, catching, running, strength and mobility work, arm-care activities, bullpen sessions, team practices, camps, clinics, evaluations, and other baseball-related training.
2. Acknowledgment and Assumption of Risk
I understand that baseball and athletic training involve inherent risks. These may include being struck by a baseball, bat, equipment, or another participant; falls or collisions; muscle, joint, tendon, ligament, or bone injuries; head or facial injuries; overuse injuries; illness; equipment failure; and other injuries associated with physical activity. I knowingly and voluntarily accept these risks for myself, or for my minor child if I am signing as a parent or legal guardian.
3. Physical Readiness and Medical Conditions
I confirm that the participant is physically able to take part in the activities for which he or she is registered. I will inform Pathway Baseball Group of any known injury, medical condition, limitation, or restriction that could affect safe participation. Pathway Baseball Group does not provide medical diagnosis, medical treatment, physical therapy, or medical clearance.
4. Release of Liability
To the fullest extent permitted by applicable law, I release and agree not to hold liable Pathway Baseball Group, its owners, employees, coaches, contractors, volunteers, agents, and any facility used for Pathway activities for claims arising from the ordinary risks of participation or ordinary negligence associated with the activities described above. This release does not apply to conduct that cannot legally be released or waived, including willful, wanton, reckless, or intentional misconduct.
5. Emergency Care
If an emergency occurs and I cannot be reached, I authorize Pathway Baseball Group personnel to contact emergency medical services and to take reasonable steps to obtain care for the participant. I understand that I am responsible for any medical expenses incurred.
6. Rules and Safety
I agree that the participant will follow reasonable safety instructions, facility rules, and coaching directions. Pathway Baseball Group may stop or modify participation when it believes doing so is appropriate for safety, behavior, or training reasons.
7. Understanding of Waiver
I understand that this waiver affects legal rights. I have read it, understand its purpose, and have had the opportunity to ask questions before agreeing. If the participant is a minor, I confirm that I am the participant's parent or legal guardian and have authority to agree on the participant's behalf.
PART II - SERVICE, EVALUATION & WEBSITE DISCLAIMER
Pathway Baseball Group provides baseball instruction, player evaluation, development planning, mentorship, education, and advisory services. The purpose of this disclaimer is to clearly explain the limits of those services.
1. No Guarantee of Results
Baseball development and recruiting are influenced by many factors outside Pathway Baseball Group's control. Pathway does not guarantee improved performance, team selection, playing time, roster placement, college recruitment, admission, scholarships or financial aid, professional opportunities, or any other specific athletic outcome.
2. Evaluations Are Professional Opinions
Player evaluations, grades, projections, recommendations, and development priorities reflect professional judgment based on the information, performance, and video available at the time of evaluation. They are not promises of future performance and may differ from the opinions of coaches, scouts, colleges, or other evaluators.
3. Video and Remote Evaluation Limitations
Remote evaluations are limited by the quality, completeness, camera angles, context, and recency of the video and information submitted. In-person observations may produce different or additional conclusions.
4. Recruiting and Advisory Services
Pathway Baseball Group may provide guidance regarding player development, recruiting strategy, communication, showcases, program fit, and next-step planning. Pathway does not control the decisions of schools, coaches, athletic departments, admissions offices, financial-aid offices, governing bodies, or professional organizations.
5. Eligibility, Rules, Scholarships, and Financial Information
College eligibility rules, roster rules, scholarship structures, financial-aid practices, and recruiting regulations can change. Information provided by Pathway is educational and should be independently confirmed with the appropriate school, governing body, compliance office, financial-aid office, or other qualified professional before a family makes a significant decision.
6. Not Medical Advice
Training, throwing, arm-care, strength, mobility, and workload recommendations are educational and developmental in nature and are not medical advice, diagnosis, treatment, physical therapy, or medical clearance. Players with pain, injury, symptoms, or medical concerns should consult an appropriate licensed healthcare professional.
7. Athletic Participation Involves Risk
Baseball and physical training involve inherent risks of injury. Participation in Pathway activities is voluntary and is subject to the liability waiver and assumption-of-risk terms above.
8. Third-Party Services and Information
Pathway Baseball Group may reference or recommend third-party facilities, events, coaches, technology, websites, programs, or services. Pathway does not control those third parties and does not guarantee their availability, accuracy, quality, safety, pricing, or results.
9. Family Decision-Making
Pathway's role is to provide honest information, professional perspective, and guidance. Final decisions regarding training, participation, travel teams, showcases, recruiting, schools, medical care, finances, and other matters remain the responsibility of the player and family.
